Litigation Services

Expert Witness Services

When litigation occurs, we have experienced accountants that can function as an expert witness. As qualified professionals, we can present an opinion to support or oppose evidence submitted to the court.

Litigation Support

Litigation support involves the quantification of economic damages pursuant to existing or pending litigation using accounting and auditing techniques. Our experienced accountant can compile information efficiently to assist in the calculation and documentation of any potential economic loss or damages.

Practice Areas: Divorce, Tax and Business Disputes/Dissolution, Real Estate Related Cases, Insurance Claims, Expert Witness Testimony, Economic Damage Calculations, Civil Litigation, Mobile Home and more.

Litigation Strategy

We serve as excellent strategic advisors on your particular issues and provide expert testimony when required. We assist counsel on analyzing documents, evaluating reports presented by other experts, preparing rebuttal reports, and aid in proposing questions for deposition and cross-examination of witnesses. Our staff excels in innovation and skill at handling complex issues.

Case Studies

Gary Capata, Senior Partner, has testified in more than 150 cases. Although every matter is important, there are several that highlight the level of excellence that is the hallmark of our Orange County CPA firm.

1.Palm Medical Group – In the often-cited opinion of the California Supreme Court Sargon Enterprises Inc. v. the University of Southern California, 55 Cal. 4th 747 (2012), The Court of Appeal majority found that the case of Palm Medical Group, Inc. v. State Comp. Ins. Fund (2008) 161 Cal.App.4th 206 ― is an excellent example of the level of care an expert should exercise. In Palm Medical, a medical clinic sued, claiming it was wrongly denied admission into a preferred provider network. The Court of Appeal upheld a lost profits award. But there the plaintiff‘s expert based his lost profits estimate on the plaintiff‘s own profit margin and a comparison to the profits of other clinics that had participated in the preferred provider network from which the plaintiff had been excluded. (Id. at p. 227.) As far as the opinion indicates, the plaintiff and the other clinics were, in fact, comparable.

2. Defendant vs. U.S. Government – This was a very high-profile case where Gary was retained. It was obvious that the judge had already decided the guilt of the defendant. In his three days of testimony, Mr. Capata went from the judge openly despising him and his client, to listening to how the government had actually entrapped the defendant and perjured themselves.

3. Marriage Dissolution (Petitioner) – Gary had documentary evidence that the respondent (and his attorney) did not properly inquire about during deposition. Needless to say, upon testifying, the judge asked the parties to settle based on this evidence.

4. Participated in numerous mobile home park rent control hearings. With Gary’s years of experience on the Laguna Niguel City Council and other civic duties, he was able to provide an accomplished perspective unknown to other accounting experts.

An interim CFO will work with you to understand your goals and current frustrations. We come alongside to support your accounting team to ensure strategic processes are put in place and improve accounting operations as a whole. Whether you want to sell, buy, or merge your business our team works with you to ensure a successful outcome.

What can a CFO do for your company?

External Benchmarking

Doing an external comparison of your company with market leaders can identify valuable solutions to increase your profitability. By analyzing competitor financial practices, marketing, and sales activities, risk, performance, research and development practices, etc. your CFO can lead your team in implementing efficient business model changes. Having access to this data gives greater clarity when setting your business performance targets. You’ll be able to save time in knowing what next steps to take by using the information to drive team decision making.

Should your firm hire a fractional CFO?

A fractional CFO is typically onboarded when you find there are frustrations that the current accounting team does not either have the bandwidth to service or the skillset to tackle.

Regardless if there is an in-house CFO or not, a fractional CFO will collaborate with the team to complete specific projects such as cash flow issues or take on the lead in guiding a due diligence audit.

By creating customized financial forecasts and preparing budgets, a fractional CFO will help your company analyze potential future products, services, and markets.

If you are ready to take your business to the next level, a fractional CFO will support you by ensuring you not only have the right systems/vendors in place but also have the financial capital you need to scale.
